Important Tax Information for Sellers
As a farmer in Saskatchewan, you may be eligible for the Lifetime Capital Gains Exemption (LCGE) when selling your farmland. The exemption allows you to exclude up to $1,000,000 of capital gains from your taxable income, as long as you've owned the land for at least two years and your gross farm income has exceeded all other sources of income during that time.
If you're married, your spouse may also be eligible for a separate exemption of up to $1,000,000 — meaning a farming couple could potentially shelter up to $2 million in capital gains.
A few things to keep in mind: if you receive the Old Age Security pension, you may need to pay back a portion of any capital gains exemption claimed in those years. You may also be subject to the Alternate Minimum Tax (AMT). The LCGE is a lifetime exemption — if you sell $500,000 worth of farmland now, you still have $500,000 available for future transactions.
